1. Terms and Conditions
In using this website, you are deemed to have read and agreed to the following terms and conditions: The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements:
"Buyer", "You" and "Your" refers to you, the person accessing this website, ordering, purchasing items and accepting the Company’s terms and conditions.
"Marketplace" means the online venue located at www.azmodesty.com
"Seller" refers to person(s) and entities registering to sell items in our online marketplace
"The Company", "Ourselves", "We" and "Us", refers to our Company; A-Z Modesty, Located at (insert address)
"Party", "Parties", or "Us", refers to "Buyers", "Sellers" and "A-Z Modesty" whether jointly or independently
A-Z Modesty acts as a marketplace connecting Sellers with customers by advertising their products on the website. A-Z Modesty is not directly involved in the transaction between buyers & sellers and therefore has no control over quality, truth or accuracy of listings.
1.1 Agreement to Terms.
By accessing or using this Website, creating an Account, placing an Order, or otherwise interacting with our Services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms, you must not use this Website or place an Order. These terms form a legally binding contract between you and the Seller for the purchase of products, and between you and A-Z Modesty as the operator of the Marketplace. This website is owned and operated by A-Z Modesty LLC, a Delaware company.
1.2 Customer Accounts.
Where applicable, you may be required to create an account (“Account”) to place Orders or access certain features. You agree to provide accurate and complete information and to keep your login credentials secure. You are responsible for all activity under your Account and must notify us immediately of any unauthorised use.
1.3 Minimum Age
You must be over the age of 18 to use the website, and to create accounts and place Orders.
2. Sales Contract
2.1 Orders placed by you on the website www.azmodesty.com (the "Website") for the products offered by sellers through the website are only an offer to conclude a sales contract. The sales contract is entered into upon the confirmation of the order by e-mail by seller to you.
2.2 You are the individual or individuals placing the order ('you', 'your'). You must be 18 years or over to enter into a contract with us by placing an order with us, you confirm that you are 18 years or over.
2.3 This contract is between you and the seller. No other person shall have any rights to enforce any of its terms. Neither party will need to get the agreement of any other person in order to end the contract or make any changes to these terms.
YOU AGREE THAT A-Z MODESTY IS A MARKETPLACE AND AS SUCH IS NOT RESPONSIBLE OR LIABLE FOR CONTENT, DATA, GRAPHICS, PHOTOGRAPHS, DESCRIPTIONS, VIDEOS AND LINKS POSTED BY YOU OR OTHER USERS. YOU AGREE THAT YOU USE A-Z MODESTY WEBSITE AT YOUR OWN RISK.
3. Order Placement
3.1 Our shopping pages will guide you through the steps you need to take to place an order through the marketplace. Our order process allows you to check and amend any errors before submitting your order to us. Please carefully check your order at each page of the order process.
3.2 After you have placed an order, you will receive an e-mail from the Seller acknowledging that they have received your order. Please note that this does not mean that your order has been accepted.
3.3 Sellers will confirm order acceptance to you by sending you an e-mail that confirms that the Products have been dispatched ("Dispatch Confirmation").
3.5 If Sellers are unable to verify the delivery or payment information you have supplied they may restrict delivery to the address to which your credit or debit card is registered.
4. Pricing & Availability
Whilst we try and ensure that all details, descriptions and prices which appear on the Website are accurate, errors may occur. If we discover an error in the price of any products which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the Products, you will receive a full refund. Where applicable, prices are inclusive of VAT at the prevailing rate.
Delivery costs will be charged when you place an order. Delivery costs are displayed where applicable and included in the total price you pay at checkout.
All orders are subject to availability. All prices advertised are subject to change.
5. Payment
5.1 We process all major credit cards (American Express / MasterCard / Visa) debit cards (Solo / Maestro / Visa Debit / Visa Delta / Visa Electron) and PayPal payments.
5.2 Your credit card or other account detailed at 4.1 above will be debited when you click on the "confirm" button.
5.3 All payments are processed through third party payment gateways using PCI Encryption. We therefore do not hold, store or process any payment information.
5.4 If payment is declined, reversed, or later charged back, the Seller is not obliged to fulfil the Order. We reserve the right to suspend or cancel Orders where payment cannot be successfully completed.
5.5 Prices are displayed in the currency shown on the Website and include VAT (or local applicable sales tax) where applicable unless stated otherwise. Additional currency conversion fees or charges imposed by your payment provider may apply and are not the responsibility of A-Z Modesty.
6. Delivery
6.1 Deliveries are not made to PO Box or hotel addresses.
6.2 The Product will be your responsibility from the time Seller delivers the Product to the delivery address you gave us.
6.3 As stated in Clause 8 within this Agreement, we do not refund postage costs, except as required by statute.
6.4 Dispatch times may vary according to availability and no guarantees or representations are made as to delivery times. Our expected dispatch time is 24-72 hours depending on the nature of the order and the Seller. After our confirmation email for the order has been sent, it is not possible to change delivery details and there will be no refund of delivery charges due to incorrect delivery details provided to us by you.
6.5 If you wish to return a product, you are responsible for paying the cost to return it to the Seller's specified address.
7. Limitation of Liability
7.1 As a condition of use of this Website, you may be liable for any damages arising out of claims resulting from your use of this Website, including without limitation any claims alleging facts that if true would constitute a breach by you of these terms and conditions.
7.2 Subject to the following sub clauses, in no event shall the aggregate liability of any party to the other (whether it contract, tort (including negligence) or otherwise) and in respect of all claims, losses and damages arising under or in connection with these Terms and Conditions:
7.2.1 provided that this shall be subject to an overall limit of the total amount paid to A-Z Modesty under a confirmed order in respect of any and all claims, losses and damages arising under or in connection with these terms and conditions.
7.2.2 The above limits on liability shall apply in respect of (any indemnities provided by either party under this Agreement, including without limitation to the indemnities under clauses 12 Intellectual Property)
7.2.3 Each party's liability to the other in contract, tort (including negligence), misrepresentation (whether innocent or negligent), breach of statutory duty or otherwise arising out of or in connection with these terms and conditions shall not extend to any:
1. loss of profits;
2. loss of business opportunity;
3. loss of goodwill;
4. loss of data;
5. loss of anticipated savings; or
6. any special, indirect or consequential loss or damage whatsoever.
7.2.4 The parties agree that the limitations on liability within these terms and conditions are reasonable given their respective commercial positions and ability to purchase relevant insurance in respect of risks.
7.2.5 Notwithstanding the above or other limitations and exclusions of liability set out in these terms and conditions, neither party excludes or limits any liability for:
1. fraud or fraudulent misrepresentation; or
2. any breach of any obligations implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982; or
3. any other liability to the extent the same cannot be excluded or limited by law.
8. Returns & Refunds
Our Returns Policy applies to all purchases made on A-Z Modesty and are incorporated by reference in these Terms.
8.1 Returns and Exchange Policy
If you are not entirely satisfied with the product purchased, you can return it to the Seller within the 'cooling off' period of 14 days. Sellers will exchange the product for an item of the same value. If you are based in the UK, your statutory rights under the Consumer Rights Act 2015 (the "Regulations") to reject faulty goods within thirty (30) days applies in addition. Certain Products may be excluded from return for hygiene or safety reasons where permitted by law. Any such exclusions will be clearly stated on the Product page.
8.2 Unused products, with all of the original receipts and packaging must be post-marked to us within 14 days of receiving your order for a full refund, to be paid within 14 days. Refunds will be made to the original payment method unless otherwise agreed. Processing times may vary depending on your payment provider.
8.3 If you wish to return a Product to the Seller, either under the rights provided by the Regulations or if you believe the Product is damaged or is the subject of a fault, and you are relying upon your statutory rights and/or you believe that the Product is covered by our warranty, you should not make further use of the Product. Use of the product can in circumstances outside of the Regulations lead to a reduction in the amount of refund you may be entitled to.
8.4 A-Z Modesty does not accept returns directly and it is your responsibility to return the item directly to the Seller. Seller details are available on all your order confirmation correspondence.
If, however, you would like a full refund then the following process must be followed.
a.) Please email Seller to inform them that you would like to return your item;
b.) Return all original packaging;
c.) Quality checking/assessment will take place once the item(s) are received;
d.) Once received and checked you will receive an email which will confirm any further course of action if necessary;
g.) The Seller (or A-Z as applicable) will refund any money received from you, normally by using the same method originally used by you to pay for your purchase.
Sellers do not normally refund postage costs save where this is required by law.
9. Gift vouchers and promotions
Gift vouchers may be available for sale from time to time and if so, the terms linked to the purchase, issue and use of gift vouchers will be available on the website.
From time to time, A-Z Modesty may run promotions where certain Products are available for sale at a discounted rate or on special terms. Please see the Website for details.

11. Intellectual Property
A-Z Modesty ("A-Z Modesty") respects and rigorously abides by intellectual property laws. Accordingly, A-Z Modesty rightfully expects the same of all parties who use our website. A-Z Modesty and/or its affiliates are owners or lawful licensees of all content (including but not limited to designs, logos, colour schemes, graphics, graphic styles, text, images and video/audio sequences) displayed on this website. Any unauthorized copying, publication, reproduction or distribution of copyrighted works is an infringement of the copyright owners' rights and is therefore prohibited. You may not, except with our express prior written permission (on whatever terms we deem appropriate), distribute or commercially exploit the content. Nor may you transmit it or store it in any other website or other form of electronic retrieval system.
Any unauthorized use of A-Z Modesty (without limitation) patents, trademarks, service marks, logos, slogans, screen shots, graphics, graphic styles, designs, blog posts, copyrighted materials or any branded features ("A-Z Modesty Proprietary Property") without the prior written permission of A-Z Modesty is strictly prohibited. If you infringe upon A-Z Modesty rights with respect to any A-Z Modesty Proprietary Property, you will be ordered to cease such illegal activity and you may be liable to A-Z Modesty for any and all damages (including recovery of legal fees and expenses) which may be suffered and/or incurred as a result of your infringement.

12. Termination
You may at any time cease to be a User of the Website and terminate these terms by going to the Website and choosing the relevant options.
If we consider in our absolute discretion that you are in breach of any of the provisions of these terms, we reserve the right to prevent your continued use of the Website without notice and accessing all avenues open to us in taking appropriate action in relation to your use of the Website.
13. International Use
We make no representation that any of the Products or any materials on the Website are appropriate or available for use in locations outside the United Kingdom and accessing them from territories where their contents are illegal is prohibited. Those who choose to access the Website and purchase products from locations outside the United Kingdom do so at their own risk and are responsible for ensuring product compliance with local requirements and laws.
14. Force Majeure
14.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control.
14.2 A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
(a) strikes, lock-outs or other industrial action;
(b) civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
(c) fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
(d) impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
(e) impossibility of the use of public or private telecommunications networks;
(f) the acts, decrees, legislation, regulations or restrictions of any government; and
(g) pandemic or epidemic.
14.3 Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
15. Entire Agreement
Save in respect of Users that have entered into separate written agreements with A-Z Modesty regarding their commercial use of the Website, the Terms of Use, these Terms and Conditions and the Privacy Policy set out the entire understanding and agreement of the parties as to the subject matter hereof and supersede all prior proposals, discussions or agreements with respect thereto. Nothing in these Terms limits or excludes your statutory rights as a consumer under UK law.
16. Miscellaneous
If there is any conflict between these Terms and Conditions and any specific terms appearing elsewhere on the Website, then these Terms and Conditions shall prevail.
17. Governance
These Terms and Conditions and your use of this site will be governed by and construed in accordance with English Law.
18. Severability
If any of the clauses herein are determined to be illegal, invalid or otherwise unenforceable under English Law, then to the extent that the term is illegal, invalid or unenforceable, it shall be severed and deleted from these Terms and Conditions and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.
Please note that nothing contained in these Terms and Conditions of Sale in any way affects your statutory rights.
19. Privacy and Data Protection
We process your personal information in accordance with our Privacy Policy. By using the Website and placing Orders, you acknowledge and agree that your data will be collected, stored, and processed as described in the Privacy Policy, and in compliance with UK GDPR and applicable data protection laws. You consent to such processing and warrant that all data you provide is accurate. In the event that you process personal data in a commercial capacity, you agree to comply with all data protection laws applicable to your jurisdiction and jurisdiction of processing activities.
20. Changes to Terms
We may update these Terms from time to time. Changes will be effective when posted on the Website with an updated effective date. Your continued use of the Website after changes are posted means you accept the revised Terms.
21. Governing Law.
These Terms are governed by and construed in accordance with English law.
22. Consumer Disputes.
If a dispute arises, please contact customer support to seek an amicable resolution. If unresolved, you may pursue statutory dispute mechanisms or alternative dispute resolution as available under applicable law.
If a dispute arises between a Buyer and a Seller relating to an Order, we encourage you to contact the counterparty directly in the first instance to seek resolution.
Where a dispute cannot be resolved directly, A-Z Modesty will, upon request, act as an intermediary to facilitate communication and seek an amicable resolution between a Buyer and the Seller. A-Z Modesty does not adjudicate disputes or make binding decisions unless required by law.
If a dispute remains unresolved following mediation, you may pursue any rights or remedies available to you under applicable law, including alternative dispute resolution or court proceedings.
Seller Agreement

This Seller Agreement (the "Agreement") is entered into between A-Z Modesty ("A-Z Modesty", "we", "us", or "our") and (the "Seller").
The Seller has agreed to participate in the A-Z Modesty marketplace, and A-Z Modesty has agreed to onboard the Seller subject to the terms and conditions set forth herein.
This Agreement shall become effective upon the Seller’s initial listing of products on the platform and shall remain in effect unless terminated in accordance with this Agreement.
1. Our Relationship
1.1 A-Z Modesty provides an online platform enabling sellers to list and sell products directly to end users (the “Platform”). By uploading products to the Platform, the Seller appoints A-Z Modesty as its non-exclusive agent solely for the purpose of marketing and facilitating sales.
1.2 Any contract for the sale of products is formed exclusively between the Seller and the buyer. A-Z Modesty is not a party to any such contract. A-Z Modesty operates purely as a marketplace connecting Buyers and Sellers and does not sell products directly at this time.
1.3 A-Z Modesty reserves the right, in its sole discretion, to suspend, remove, or exclude any product that does not comply with this Agreement or any applicable policies.
1.4 The Seller agrees that it shall not, whether directly or indirectly: - include links to third-party websites; - include email addresses, phone numbers, or other direct contact details; or - otherwise attempt to communicate with buyers outside the Platform, except as necessary for order fulfillment through Platform-approved channels.
1.5 This Agreement shall commence on the date the Seller first uses the Platform and shall continue unless terminated in accordance with this Agreement.
2. Advertised Products
2.1 The Seller shall maintain accurate inventory levels for all listed products.
2.2 The Seller shall provide accurate retail pricing, descriptions, and high-quality images for all products.
2.3 The Seller warrants that all product listings meet professional presentation standards.
2.4 All customers purchasing through the Platform are customers of A-Z Modesty. Any unauthorized direct communication with customers shall constitute a material breach of this Agreement.
2.5 All confirmed sales are binding. The Seller is solely responsible for fulfilling all orders in a timely manner.
2.6 Pricing Control
The Seller retains full control over product pricing on the Platform. A-Z Modesty shall not increase product prices above those set by the Seller.
Any promotions or discounts run by A-Z Modesty shall not result in an increase to the Seller’s listed price.
3. Promotions
3.1 A-Z Modesty may conduct Platform-wide promotions from time to time. Such promotions are independent of any promotions conducted by the Seller and may include discounts, free delivery offers, vouchers, or promotional codes.
4. Payment
4.1 All payments to the Seller shall be processed through Stripe or any other payment processor designated by A-Z Modesty. The Seller is responsible for maintaining an active and compliant account with the designated payment processor.
4.2 The Seller may view real-time earnings, pending payments, and order status via the Seller Dashboard. The Dashboard provides informational data only. A-Z Modesty shall not be liable for discrepancies resulting from delayed processing or errors outside its control.
4.3 Payments are subject to deduction of applicable commissions, fees, refunds, chargebacks, and any other amounts owed by the Seller under this Agreement. A-Z Modesty may withhold payment where required due to disputes, suspected fraud, or non-compliance with platform rules.
4.4 Payments will be made in the currency determined by the designated payment processor. Any fees, currency conversion costs, or processing charges are the sole responsibility of the Seller.
4.5 The Seller acknowledges that A-Z Modesty acts solely as a payment collection agent on behalf of the Seller and does not hold funds outside the designated payment processor.
4.6 A-Z Modesty may change the payment processor used to remit payments to the Seller, provided that the Seller is notified at least seven (7) days in advance. The Seller agrees to provide all necessary information and account details for the new processor to ensure continued receipt of payments.
4.7 In the event the Seller voluntarily terminates this Agreement, the Seller agrees to provide at least thirty (30) days’ notice prior to the effective date of termination for payment reconciliation purposes. During this period, the Seller remains responsible for fulfilling all outstanding orders.
4.8 Commission Calculation
Commission shall be calculated solely on the net product price. Commission shall not apply to shipping fees, VAT, sales tax, customs duties, or any other governmental charges.
4.9 Invoicing
Sellers are not required to issue invoices in order to receive payment. Payments are processed via Stripe, and each Seller shall have access to a dedicated dashboard to view transactions, payouts, fees, and order status.
Returns shall be governed by the Seller’s return policy in effect at the time of purchase.
Where a return is accepted, A-Z Modesty shall refund the customer and refund the Seller accordingly, including reversing any commission charged for the returned order.
5. Fulfillment & Shipping
5.1 The Seller is solely responsible for shipping all orders promptly.
5.2 A-Z Modesty shall not be liable for incorrect or additional shipping costs charged by the Seller.
5.3 Customers are responsible for all applicable import and export duties.
5.4 The Seller shall notify A-Z Modesty when an order is being prepared and again upon dispatch, including valid tracking information.
5.5 Legal title and risk of loss remain with the Seller until the buyer receives the product.
5.6 Except for made-to-order products, the Seller shall dispatch all orders within two (2) working days of the order date. Failure to comply may result in warnings, and three (3) warnings shall constitute grounds for immediate termination.
5.7 Shipping Rates and Regions
The Seller shall determine its own shipping rates and the countries or regions to which it ships via the Platform. A-Z Modesty offers flat-rate shipping functionality, and all shipping information provided by the Seller shall be automatically reflected at checkout for customers.
5.8 Seller Policies
The Seller shall upload and maintain its own shipping, returns, and refund policies. These policies shall be displayed on the Seller’s storefront and shall be binding on customers at the time of purchase. All Sellers must handle returns themselves. Payment refunds are processed by A-Z Modesty for all Sellers, except Standard Stripe Sellers, who handle refunds directly.
5.9 Customs Duties and Import Taxes
Customers are responsible for paying any applicable customs duties, import taxes, or tariffs on international orders. Neither the Seller nor A-Z Modesty shall be liable for such charges.
6. Taxes
The Seller is solely responsible for determining, charging, collecting, and remitting any applicable VAT, sales tax, or similar taxes arising from sales made through the Platform.
A-Z Modesty does not calculate, collect, or remit taxes on behalf of the Seller.
Taxes are excluded from commission calculations.
7. Warranties & Limitation Of Liability
A-Z MODESTY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8. Ownership Of Social Media Contacts
Any social media accounts or contacts created or managed by A-Z Modesty in connection with the Platform shall remain the exclusive property of A-Z Modesty.
9. Termination
9.1 Immediate Termination by A-Z Modesty: A-Z Modesty may terminate this Agreement immediately, without notice, if the Seller materially breaches this Agreement, violates the Code of Conduct, engages in fraud, or otherwise acts in a manner deemed harmful to the Platform or its users.
9.2 Voluntary Termination by Seller: The Seller may terminate this Agreement at any time by providing written notice to A-Z Modesty. For the purpose of finalizing payments, commissions, and pending obligations, the Seller agrees to provide at least thirty (30) days’ notice prior to the effective date of termination. During this notice period, the Seller remains responsible for fulfilling all outstanding orders and complying with all obligations under this Agreement.
9.3 Effect on Payments: Upon immediate termination by A-Z Modesty or voluntary termination by the Seller, pending payments will be calculated and processed in accordance with the standard payment terms, subject to deductions for refunds, chargebacks, fees, or other amounts owed by the Seller.
10. Remedies
If either party materially breaches this Agreement, the non-breaching party may provide written notice and allow seven (7) days to cure. Failure to cure shall result in termination.
11. Force Majeure
Neither party shall be liable for failure to perform due to events beyond reasonable control, provided prompt notice is given and reasonable efforts are made to resume performance.
12. Dispute Resolution
The parties shall attempt to resolve disputes through good-faith negotiations. If unresolved, disputes shall be submitted to mediation. If mediation fails, disputes shall be finally resolved by arbitration administered by the London Court of International Arbitration (LCIA). The seat of arbitration shall be London, and the language shall be English.
13. Confidentiality
Both parties agree to keep confidential all non-public business information disclosed under this Agreement.
14. Notice
Notices shall be delivered in writing by hand or certified mail and shall be deemed received upon delivery.
15. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements.
16. Amendment
This Agreement may be amended only in writing signed by both parties.
17. Severability
If any provision is held invalid, the remaining provisions shall remain in full force and effect.
18. Waiver
Failure to enforce any provision shall not constitute a waiver.
19. Governing Law
This Agreement shall be governed by and construed in accordance with English law, regardless of the Seller’s country of residence. The Seller irrevocably agrees that English law shall apply notwithstanding any mandatory local laws to the extent permitted by law.
20. Global Seller Compliance
The Seller represents and warrants that it complies with all applicable local, national, and international laws, including export controls, sanctions, consumer protection laws, and product safety regulations. A-Z Modesty reserves the right to suspend or terminate access to the Platform for violations of this provision.
